The website https://boutique.mansa.fr (hereinafter “the Store”) is operated by the MISSION DE PRÉFIGURATION DE MANSA – MAISON DES MONDES AFRICAINS (hereinafter “the Seller”), a public interest group, registered under SIREN number 929 381 820, with its registered office located at 182 Rue Saint-Honoré, Ministry of Culture, 75001 Paris, represented by its director, Ms. Élisabeth GOMIS.
These General Terms and Conditions of Sale (hereinafter “GTC”) govern all sales of products made by the Seller to any customer, whether a consumer or a business (hereinafter “the Customer”), through the Store. Any order placed on the Store implies full and unconditional acceptance of these T&C, which shall prevail over any other document, unless otherwise expressly agreed in writing by the Seller.
The Seller reserves the right to modify these Terms and Conditions at any time. The Terms and Conditions applicable to an order are those in effect on the date the order is confirmed.
Article 1 – Seller Identification

Article 2 – Products
2.1 Nature of the products
The store currently offers only one product category:
- MansA magazine: a biannual cultural publication (two issues per year), sold individually per issue.
The products available for sale are those displayed in the Store at the time the Customer views them, subject to availability. Photographs and images are provided for illustrative purposes only and are not binding.
If a product is unavailable after the order has been confirmed, the Customer will be notified by email as soon as possible. The order may then be automatically canceled, and the Customer will receive a full refund within fourteen (14) days.
2.2 Magazine Prices and the Fixed Book Price Law
Since MansA magazine constitutes a publication with substantial editorial content within the meaning of the tax definition of a book, its retail price may be subject to the fixed-price system established by Law No. 81-766 of August 10, 1981 (known as the “Lang Law”), in which case it is set by the publisher and is binding on all retailers. The Seller then reserves the right to grant a maximum discount of 5% to individual customers.
The VAT rate applicable to the magazine is 5.5%, in accordance with Article 278-0 bis of the General Tax Code.
Article 3 – Price
Product prices are listed in euros (€), inclusive of all taxes (TTC), excluding shipping costs. The Seller reserves the right to change its prices at any time; the price applicable to the order is the one listed at the time the Customer confirms the order.
In accordance with Law No. 2021-1901 of December 30, 2021 (known as the “anti-Amazon law”), a minimum shipping fee of €3 will be charged for all orders of new books totaling less than €35 (including tax). Free shipping on new books is prohibited. Shipping fees are listed separately during the ordering process.
For any order shipped to a country outside the European Union and the French overseas departments and territories, customs duties, import taxes, or other charges may be due upon receipt. These costs are the sole responsibility of the Customer. The Customer is advised to check with their country’s customs authorities before placing an order.
Article 4 – Order
To place an order in the Store, the Customer should follow these steps:
- Select the desired product(s) and add them to your cart;
- Check the contents of your cart and correct any errors;
- Enter or confirm your contact information (shipping and billing addresses);
- Choose your shipping method;
- Complete the online payment by finalizing your order.
The Customer’s confirmation of the order constitutes an irrevocable acceptance. A confirmation email is sent to the email address provided, summarizing the products ordered, the total amount, the selected shipping method, and the shipping address. The sale is deemed to be concluded upon receipt of this confirmation email and payment.
The Seller reserves the right to refuse or cancel any order in the event of a dispute regarding payment for a previous order, an anomaly detected by fraud prevention systems, or any other legitimate reason as defined in Article L. 122-1 of the French Consumer Code.
Article 5 – Payment
Payment is made online at the time the order is confirmed. Transactions are secured by the payment service provider PayZen (Lyra Network / Lyra Collect). The Customer’s banking information does not pass through the Seller’s servers and is neither collected nor stored by the Seller.
Transactions may be subject to enhanced 3-D Secure authentication, in accordance with the requirements of Directive (EU) 2015/2366 on payment services (PSD2). In the event of a payment refusal, authentication failure, or detection of a fraud risk, the order is automatically canceled and has no legal effect. The Seller is not obligated to fulfill the order.
Ownership of the ordered products is transferred to the Customer upon full payment of the price, including shipping costs (retention of title clause).
Article 6 – Delivery
6.1 Delivery Area
The Seller delivers orders to mainland France, the French overseas departments and territories, and internationally. All sales are conducted exclusively online.
6.2 Carrier
MansA magazine is shipped by the logistics provider OML – Direktmarketing und Logistik GmbH & Co. KG (Hamburg/Berlin, Germany), which specializes in magazine distribution. Final delivery is handled by OML’s partner postal operators and carriers, depending on the destination.
6.3 Delivery Times
The estimated delivery times, provided at the time of ordering, begin upon confirmation of payment. They vary depending on the destination and the selected shipping method. These times are provided for informational purposes only and do not constitute a binding commitment.
In the event of a delivery delay exceeding thirty (30) calendar days from the specified date, the consumer Customer may terminate the contract in writing on a durable medium (including by email to boutique@mansa.fr), if the Seller has not fulfilled its obligations within a reasonable additional period granted. The Seller shall then refund the Customer the full amount paid within a maximum of fourteen (14) days in accordance with Articles L. 216-2 et seq. of the French Consumer Code.
6.4 Acceptance – Inspection – Reservations
Upon receipt of the order, the Customer is required to check its condition and ensure it is in order. Any apparent issues (damaged, incomplete, or opened package; missing or non-compliant product) must be:
- reported to the carrier at the time of delivery by expressly noting reservations on the delivery slip; if necessary, confirmed by registered letter with return receipt within three (3) days of delivery, in accordance with Article L. 133-3 of the Commercial Code;
- notified to the Seller by email at boutique@mansa.fr within five (5) business days of receipt, along with any relevant supporting documentation (photos, order number).
After this period has elapsed, no claims regarding the apparent condition of the package upon delivery will be considered, without prejudice to the Customer’s rights under the statutory warranties referred to in Article 8 herein.
Article 7 – Right of Withdrawal
7.1 Exclusion for MansA magazine
In accordance with Article L. 221-28(13) of the French Consumer Code, the right of withdrawal does not apply to the supply of newspapers, periodicals, or magazines. Consequently, the sale of a single copy of MansA magazine does not give rise to a right of withdrawal. The Customer is expressly informed of this prior to confirming their order, in accordance with Article L. 221-5 of the French Consumer Code.
This exclusion does not deprive the Customer of the rights arising from the statutory warranties referred to in Article 8 hereof (warranty of conformity and warranty against hidden defects).
Article 8 – Statutory Warranties
8.1 Legal Guarantee of Conformity
In accordance with Articles L. 217-3 et seq. of the French Consumer Code, the Seller is required to deliver goods that conform to the contract. In the event of a lack of conformity, the consumer Customer has a period of two (2) years from the delivery of the goods to take action. The Customer may first request repair or replacement of the goods, or, failing that, a price reduction or rescission of the contract. During the twenty-four (24) months following delivery of the goods, the consumer Customer is exempt from providing proof of the existence of the lack of conformity (presumption of prior existence).
8.2 Warranty Against Hidden Defects
In accordance with Articles 1641 et seq. of the Civil Code, the Seller is liable for hidden defects that render the property unfit for its intended use, or that so impair its use that the buyer would not have purchased it or would have paid a lower price had they been aware of such defects. The Customer must take action within two (2) years of discovering the defect. The Customer may choose between rescission of the sale or a reduction in the price.
8.3 Enforcement of Security Interests
To exercise any of these warranties, the Customer must contact the Seller at boutique@mansa.fr, describing the defect found and attaching any relevant evidence (photos, order number, invoice). The Seller agrees to review the claim as soon as possible and to propose an appropriate solution (replacement, refund, etc.).
Article 9 – Liability
The Seller shall not be held liable in the following cases:
- fault, negligence, or failure by the Customer to follow the instructions for use;
- inaccurate information provided by the Customer when placing the order (including an incorrect shipping address);
- failures attributable to transport operators or third-party service providers independent of the Seller;
- cases of force majeure as defined by French law and case law (natural disasters, strikes, armed conflicts, widespread communication network outages, epidemics, government actions, etc.).
Under no circumstances shall the Seller be liable for indirect, incidental, consequential, or lost-profit damages, even if the Seller has been advised of the possibility of such damages.
Article 10 – Intellectual Property
All content on the Store (text, images, graphics, logos, etc.) as well as the editorial content of MansA magazine are protected by French and international intellectual property laws. They are the exclusive property of the Seller or its partners. Any reproduction, representation, or use, in whole or in part, without the prior written authorization of the Seller, is strictly prohibited and exposes the offender to civil and criminal prosecution.
Article 11 – Personal Data
Personal data collected in connection with orders is processed by the Seller as the data controller, in accordance with Regulation (EU) 2016/679 (GDPR) and the amended Law No. 78-17 of January 6, 1978 (Data Protection Act).
This data is used for order processing, customer relationship management, fraud prevention, and, subject to the Customer’s prior consent, to send marketing communications. It is hosted in France by O2SWITCH and is not shared with third parties other than service providers strictly necessary for order fulfillment.
The Customer has the right to access, correct, delete, restrict, transfer, and object to the processing of their personal data, which may be exercised by emailing dpo@mansa.fr. For further information, the Customer is invited to review the Privacy Policy available on the Store.
Article 12 – Mediation and Dispute Resolution
In the event of a dispute regarding an order, the Customer is asked to first contact the Seller’s customer service department at boutique@mansa.fr to reach an amicable resolution. The Seller agrees to respond to any complaint within a reasonable time.
In accordance with Articles L. 612-1 et seq. of the Consumer Code, if the Customer does not receive a satisfactory response within two (2) months of submitting a written complaint to the Seller, the Customer may, free of charge, seek consumer mediation through the following mediator:

These remedies do not deprive the Customer of the right to bring a legal action. In the absence of an amicable settlement, any dispute shall be submitted to the competent courts in accordance with the rules of general law and, for consumers, the protective provisions set forth in the Consumer Code.
Article 13 – Governing Law and Jurisdiction
These Terms and Conditions are governed by French law. In the event of a translation, only the French version shall be deemed authentic. In the event of a dispute, and in the absence of an amicable settlement or successful mediation, any dispute relating to the formation, interpretation, or performance of these Terms and Conditions shall be submitted to the competent courts within the jurisdiction of the Seller’s registered office, unless otherwise required by public policy rules applicable to consumers (in particular, the protective jurisdiction rules provided for in the Consumer Code).
